    Roles of Adjusters

    COMPANY/STAFF ADJUSTERS

A company/staff adjuster is an insurance company employee who investigates, evaluates, and settles claims. Staff adjusters often seek assistance from independent adjusting firms located throughout the country.

    INDEPENDENT ADJUSTERS

An independent adjuster is considered independent because they are not employed directly by the insurance company but by a third party specializing in adjusting insurance claims.  The insurance company is essentially outsourcing a portion of the claim investigation process to a claims-handling company, which reports its findings to the insurance company.

    PUBLIC ADJUSTERS

Like a staff adjuster, a public adjuster will assess the damage to your property, help determine the scope of repairs, and estimate the replacement value for those repairs.  The big difference is that public adjusters work for the policyholder while staff adjusters work for the insurance company.

After the insurance company settles the claim, the public adjuster receives a percentage of the payout amount as payment for their services.  It is important to note that insurance companies do not consider the payment owed to the public adjuster when determining the payout amount of the claim.  The payment owed to the public adjuster would come from the policyholder who hired the public adjuster.

*Note – Insurance Producers, or agents, do not directly adjust claims. However, they may play a crucial role in the claims process by assisting policyholders with the initial claim filing and helping to ensure a smooth process.

    Choosing a Contractor

Choosing a contractor can be stressful. We have provided the checklist below to make the process easier for you. This list will help you identify the necessary information you will need to make an informed decision.

    FINANCIAL STABILITY

Confirm licensing and/or registration with the state as required. All states have different requirements, so please check with your local building inspector for requirements for your city or state to ensure they are met. If this is required, the contractor should be able to provide you with a copy of their certificates.

Insurance: Do they have Commercial General Liability & Workers Compensation insurance? Request proof of such insurance.

    BACKGROUND CHECKS

Obtain referrals from your relatives, friends, or social media.

    Check consumer feedback with:

    • Better Business Bureau (bbb.org),
    • National Association of Home Builders (nahb.org),
    • Consumer Reports (consumerreports.org), or similar organizations.
    • References: Can the contractor provide you with any prior job references? Consider following up with multiple references. If possible, visit locations where work has been completed to view their work.

    CAPABILITIES

Skill levels: Do they use subcontractors or do they have their own employees? Can they provide the names of the subcontractors they would be using on your job?

Can they set up a meeting with you and the subcontractors to familiarize you with the people that would be working at your home?

Are they experienced in handling smoke and water restoration, or just new construction?

Equipment: Do they have their own tools?

Volume capacity: Will the number of jobs the contractor has impact when they can begin work on your job? How long it will take to complete the job?

Technology: Do they use estimating software, and can they provide a detailed estimate of the scope and cost of the repairs?

    BEWARE

A conflict of interest exists when a contractor attempts to receive payment as an adjuster and a fee for providing contracting services.

In most states it is illegal for a contractor to act as a public adjuster by attempting to assist the policyholder in settling their claim with the insurance company for which they are also acting as a contractor to repair the damages.
